These Terms of Service govern your use of Breakthrough Health websites, accounts, digital products, subscriptions, educational tools, generated content, and related services. By using the service or purchasing a product, you agree to these Terms and our Privacy Policy and applicable refund/cancellation terms.
Breakthrough Health is an educational wellness service
Breakthrough Health provides education, organization, planning, tracking, reflection, and self-management tools. It is not a medical practice, emergency service, psychotherapy service, pharmacy, or substitute for care from a licensed healthcare professional. The service does not create a clinician-patient relationship.
Eligibility and accounts
You must be at least 18 years old and legally able to enter into an agreement to use Breakthrough Health. You are responsible for providing accurate information, maintaining the confidentiality of your account credentials, and promptly notifying us if you believe your account has been compromised.
Your information and decisions
You control the information you choose to enter and are responsible for reviewing information before relying on or sharing it. Do not use Breakthrough Health as the sole basis for diagnosis, medication changes, treatment decisions, emergency decisions, or other decisions that require licensed professional judgment.
AI-assisted and personalized content
Some features use automated or AI-assisted systems. Where a product is described as human reviewed, that review is intended to improve quality and safety but does not convert the product into medical care. Automated and human-reviewed content may still contain errors, omissions, or information that is not appropriate for your individual circumstances. You are responsible for discussing medical questions with a qualified healthcare professional.
Purchases and subscriptions
Payments are processed through Stripe. Prices, billing intervals, and included features are shown before purchase. One-time digital products and recurring subscriptions are subject to our Refund & Cancellation Policy. Recurring subscriptions continue until canceled. You may use the billing-management tools provided in your account when available, and you should cancel before your next renewal if you do not want another charge.
Digital products and license
Unless we state otherwise, purchases give you a personal, limited, non-exclusive, non-transferable right to use the purchased Breakthrough Health materials for your own use. You may not resell, publicly distribute, reproduce for commercial use, remove ownership notices from, scrape, reverse engineer, or use the service or materials to build a competing product except where applicable law expressly permits it.
Acceptable use
You may not misuse the service, attempt unauthorized access, interfere with security controls, access another customer's information, upload malicious code, use automated systems in a way that harms the service, impersonate another person, or use Breakthrough Health for unlawful activity.
Third-party services
Breakthrough Health relies on third-party infrastructure and services, including payment, authentication, hosting, email, and AI providers. Their availability and performance may affect the service. Links to third-party resources are provided for convenience and do not mean we control or guarantee those resources.
Intellectual property
Breakthrough Health, its branding, software, original educational materials, product names, written content, graphics, and other original materials are owned by Breakthrough Health or its licensors and are protected by applicable intellectual-property laws. You retain ownership of information you submit, subject to the limited rights needed for us and our service providers to operate the features you request.
Availability and changes
We may improve, change, suspend, or discontinue features as the service evolves. We work to maintain reliable access but do not guarantee uninterrupted or error-free availability. Where a change materially affects a paid recurring service, we will take commercially reasonable steps to communicate it.
Disclaimers
To the fullest extent permitted by applicable law, the service and content are provided on an "as available" basis without warranties of uninterrupted availability, medical suitability, or particular health outcomes. We do not guarantee weight loss, behavior change, symptom improvement, or any other individual result.
Limitation of liability
To the fullest extent permitted by applicable law, Breakthrough Health will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the service. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
Suspension and termination
We may restrict or terminate access when reasonably necessary to protect customers, enforce these Terms, address fraud or abuse, comply with law, or protect the security and integrity of the service. You may stop using the service at any time and may request account deletion subject to applicable retention obligations.
Changes to these Terms
We may update these Terms as the service changes. The "Last updated" date identifies the current version. If a material change requires additional notice or consent under applicable law, we will provide it.
